AI and Ageism in the Workplace Confronting Algorithmic Bias and Discrimination

The rise of artificial intelligence (AI) is redefining how companies recruit, manage, and promote talent. But while these systems promise objectivity, they may also deepen existing inequalities, particularly when it comes to AI and ageism. As organizations lean heavily into automation to reduce costs and streamline decisions, older employees and job seekers often find themselves at a disadvantage. This trend raises urgent concerns about workplace discrimination and algorithmic bias, both of which threaten to undermine the fairness of employment practices.

Hidden Biases in Hiring Algorithms

In the past, age-based discrimination was often subtle, cloaked in euphemisms like “culture fit” or “overqualified.” Today, it can be embedded directly into the code of algorithmic systems that sift through resumes or analyze video interviews. These tools, trained on historical data, can replicate and reinforce the very biases they were meant to eliminate.

A foundational concern is the data that fuels AI models. If older workers have historically been underrepresented in hiring decisions, performance reviews, or promotions, machine learning models will mirror those patterns. A 2021 study by Cowgill, Dell’Acqua, and Deng titled Biased Programmers? Or Biased Data? found that even well-meaning developers inadvertently encode bias when training algorithms on real-world datasets. This makes algorithmic bias a function not just of design, but of the societal inequities embedded in workplace history.

The Role of Applicant Tracking Systems

Hiring platforms, such as applicant tracking systems (ATS), are particularly prone to such issues. Many filter candidates based on years of experience, graduation dates, or employment gaps, factors that often correlate with age. According to Bogen and Rieke’s 2018 report, Help Wanted: An Examination of Hiring Algorithms, Equity, and Bias,” these systems can easily exclude older applicants without any explicit intent to do so. The concern here is not malicious design, but the mechanical execution of historical discrimination at scale.

Field Experiment on Age Discrimination in Hiring

A study published in Labour Economics conducted a field experiment to assess age discrimination in the labor market. The researchers used over 6,000 fictitious resumes to complete job applications, varying only in the age of the applicants. The findings revealed robust evidence of age discrimination, particularly against older female applicants, who received significantly fewer callbacks compared to their younger counterparts. ​

These findings substantiate the concern that AI and ageism are not just theoretical but observable realities when age-related patterns are encoded into algorithmic decision-making systems.​ Yet some argue that AI can be a tool for reducing human bias. Algorithms do not “see” age in the traditional sense, they process data points. In theory, a well-designed system could ignore irrelevant demographic details and focus purely on merit. The problem, however, is that many systems still rely on proxy variables, like digital fluency, social media presence, or language patterns, that serve as stand-ins for age.

Policy and Regulation

Regulatory efforts are beginning to catch up. In New York City, Local Law 144 requires that employers using automated hiring tools conduct bias audits. At the federal level, the Equal Employment Opportunity Commission (EEOC) is reviewing how AI tools align with existing anti-discrimination laws. Meanwhile, the EU’s proposed AI Act includes provisions to safeguard against age-based bias. These efforts underscore the growing recognition that workplace discrimination must be addressed proactively, not reactively.

In addition to regulation, transparency and auditability are key. Organizations should treat AI models as fallible, requiring regular audits and human oversight. Internal reviews, external audits, and open communication with employees about how AI decisions are made can reduce the risk of algorithmic bias and promote trust.

Corporate culture also plays a critical role. Companies must reframe how they view older workers, not as liabilities to be managed, but as assets to be leveraged. In industries undergoing digital transformation, experience and institutional memory are often undervalued. Strategic workforce planning should include investments in continuous learning and inclusive design.

Promising Innovations in HR Tech

Several startups and HR tech firms are tackling this head-on. Tools like FairHire and Harver claim to reduce bias by using behavioral science and anonymized screening. While promising, these solutions must still be scrutinized. However, addressing bias is not a one-time fix, rather it is a topic that needs continuous attention.

Ultimately, the challenge is to align AI innovation with human values. The best systems will combine the precision of machines with the empathy of human judgment. AI and ageism do not have to be linked inevitabilities, with the right guardrails, companies can build more inclusive workplaces.

However, without careful oversight, AI may continue to encode and amplify workplace discrimination in ways that are difficult to detect and even harder to reverse. To mitigate this, leaders must prioritize inclusive design, support ongoing bias audits, and champion a future where experience and age are seen not as obstacles, but as organizational strengths.

The future of work is not just about automation, it is about values. As AI becomes increasingly embedded in employment decisions, our collective commitment to equity will determine whether these tools empower or marginalize. Algorithmic bias, if left unchecked, could usher in a new era of invisible discrimination, one where prejudice hides behind probability scores and data models.

To avoid that outcome, business leaders must act now. Through stronger attention, transparent practices, and inclusive cultures, we can ensure that AI and ageism do not define the next chapter of the workplace. Instead, they can serve as a warning, and a call to build systems that are not only smart but fair.
